Digital Artwork – Terms of Service

Agreement: By commissioning me, you agree to all the terms listed below.
Channels: All official communication regarding art commissions will be conducted exclusively via email (here) or through direct messages on social/art platforms (X, Instagram, Discord — all the same user jmacenajr) to ensure the security, integrity, and traceability of the entire process.
Right of Refusal: I reserve the right to refuse any request without providing an explanation.
Response Time: Art takes time to create. If I take a while to respond, it is likely because I am focused on a piece or resting. Please remember that we may be in different time zones.

Payment Methods: I accept payments via Stripe, Wise, PayPal, and Ko-Fi. If you need another payment method, please reach out so we can check its viability.
Currency & Upfront Fees: Payment must be made in US Dollars (USD) and in full (100% upfront) before I begin the rough sketch. For artworks above $60.00, you may choose to pay 50% upfront to start the sketch, and the remaining 50% after the sketch is approved (before the final lineart and coloring phases begin).
Deadline Activation: Once the payment (or the first installment) is confirmed, the turnaround time begins.
Split Payment & Turnaround: If you choose the 50/50 payment split, the final production phase (lineart, coloring, and rendering) will only begin after the remaining 50% is received. Please note that a delay in the second payment will directly postpone the final delivery date, as the official turnaround time is paused until the balance is cleared.

Turnaround Time (TAT): Between one and two weeks. If any unforeseen circumstances arise, you will be notified immediately. Revisions and changes may extend the deadline, and you will be kept updated throughout the process. Highly complex artwork may require a longer TAT.
Approval Stages: I will send the rough sketch in low resolution and watermarked for approval. Major changes to the pose or composition will only be accepted during this stage.
Revisions: You are entitled to up to three free revisions during the sketch phase. Changes after the artwork is finalized will only be made if they are minor color corrections or forgotten details.
WIP (Work in Progress): Usually, I can provide updates every 1 to 2 days, depending on the number of active commission slots.

Client Rights: The commissioned artwork is strictly for personal use (profile pictures, banners, RPG use, wallpapers, or printing for personal enjoyment/gadgets).
Commercial Use: It is strictly prohibited to profit from the artwork (selling merchandise, prints, NFTs, or using it in commercial games or media) without a separate contract and a commercial fee of 100% of the total commission value.
Artist Rights: I retain all copyrights over the drawing and may publish it on my social media networks and portfolio. If you wish for the artwork to remain private, please let me know in advance, as an exclusivity fee will apply.
Credits: You must credit me as the artist whenever the artwork is posted publicly.
No-AI Policy: It is strictly prohibited to use any of the artworks for training or any type of manipulation through any AI technology, generative or otherwise.

Before Sketch: You may request a full refund (100% of the payment made) if I have not yet started the rough sketch.
During Sketch: If work has already begun and if you opted for the split payment (50/50), the first installment is non-refundable. If you paid 100% upfront, the refund will be a maximum of 50% of the total commission value. The first non-refundable 50% covers the time and costs of the initial creation stage.
After Completion: No refunds will be issued after the artwork is completed and the high-resolution file link has been provided.
Cancellation by Artist: If I need to cancel the order due to force majeure, you will receive a 100% refund regardless of the current stage of the process.
Client Misconduct: In cases of abuse, disrespectful behavior, or violation of laws during communication, the work will be terminated immediately. The contract will be canceled with no right to a refund, and the file will be delivered "as-is" at its current stage.

Specifications: Finalized artworks will be delivered in PNG format, at an A4 resolution at 300dpi (landscape format is also available). If you require a specific resolution or orientation, you must inform me before making the first payment, as larger files affect production time, hardware demands, and the final value.
Custom Formats: If you require a different type of deliverable, please reach out so we can negotiate.
Delivery Method: Finalized files will be shared via a download link sent on the platform where the agreement was made. This signals the completion of the piece, and no further adjustments will be made.
Link Expiration: The download link will remain active for 30 days. It is your sole responsibility to safely download and store the files after receiving them.
